TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale apply to purchases made from Soilux Pty Ltd through the Soilux website.

Please read these Terms before placing an order. By placing an order with us, you agree to these Terms.

In these Terms, “Soilux”, “we”, “us” and “our” refer to Soilux Pty Ltd. “You” and “your” refer to the person purchasing a product from us.

2. Application of these Terms

These Terms apply to all orders placed through our website.

Your order is also subject to any additional information displayed on the relevant product page, including product specifications, pricing, expected availability, delivery information and promotional conditions.

If there is an inconsistency between these Terms and a specific written offer displayed on a product page, the specific offer will apply to the extent of the inconsistency.

Nothing in these Terms excludes, restricts or modifies any right or remedy you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

3. Products and product information

We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and availability information are accurate.

Product photographs are provided for illustrative purposes. Colours and appearance may vary slightly depending on lighting, photography, manufacturing variations and the screen used to view the website.

Dimensions, noise levels, energy consumption, processing times, capacity and other performance information are approximate unless expressly stated otherwise. Actual performance can vary depending on the type and quantity of food waste added, ambient conditions, maintenance, filter condition and how the product is used.

The Soilux LUX-450 processes food waste into a dry, reduced organic material. Depending on its intended use, the finished material may need to be mixed with soil, added to green waste or cured further before being used around plants. It should not be treated as fully matured compost unless it has been appropriately cured.

Products must be installed, operated, cleaned and maintained in accordance with the supplied instruction manual and safety guidance.

4. Orders

When you place an order, you are making an offer to purchase the products in your cart.

After you place an order, we will normally send an automated order acknowledgement. This confirms that we have received your order but does not necessarily mean that the order has been accepted.

A binding agreement is formed when we accept your order by:

  • sending an order confirmation;

  • confirming that your order is being prepared or dispatched; or

  • otherwise confirming acceptance in writing.

We may decline or cancel an order before dispatch where:

  • a product is unavailable;

  • the price or product information contained an obvious error;

  • we are unable to authorise or verify payment;

  • we reasonably suspect fraud or unauthorised activity;

  • delivery is not available to the address provided;

  • an order breaches a promotional condition; or

  • we are unable to fulfil the order for another reasonable operational or legal reason.

If we cancel an order after payment has been taken, we will provide a full refund for the cancelled products using the original payment method.

5. Customer information

You must provide complete and accurate information when placing an order, including your name, email address, telephone number, billing address and delivery address.

You are responsible for checking your order details before completing payment.

Please contact us promptly if any information is incorrect. We cannot guarantee that delivery details can be changed after an order has entered the dispatch process.

You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to place an order.

6. Prices and GST

All prices displayed to Australian consumers are in Australian dollars and include Goods and Services Tax where applicable.

The total amount payable will be displayed before you complete your purchase.

Standard delivery is currently provided free of charge to eligible Australian delivery addresses unless a product page, promotion or checkout page clearly states otherwise.

Optional charges, including any express delivery or additional service selected by you, will be shown before payment.

We may change product prices at any time. A price change will not affect an order that we have already accepted, except where there has been an obvious pricing or technical error.

A crossed-out, recommended retail or comparison price will only be displayed where we have a reasonable basis for using that price. Promotional prices and offers may be subject to availability, time limits, quantity limits or other conditions displayed with the offer.

7. Payment

Available payment methods will be shown during checkout and may include debit or credit card, PayPal and eligible instalment-payment providers.

Payment is normally taken when an order is placed, including for pre-orders, unless the checkout clearly states otherwise.

Where you select a third-party payment or instalment provider, your use of that service is also governed by the provider’s own terms, eligibility checks, fees and privacy practices.

We do not control whether a third-party provider approves or declines your application.

You must ensure that you are authorised to use the selected payment method and that sufficient funds or credit are available.

8. Pre-orders

A product described as a “pre-order” is not yet available for immediate dispatch.

The expected dispatch or availability date displayed on the product page is an estimate and is not guaranteed. Manufacturing, import, customs, freight and other circumstances outside our reasonable control may affect availability.

Payment for a pre-order may be collected when the order is placed.

If the estimated dispatch date changes materially, we will make reasonable efforts to notify you using the contact details supplied with your order.

Unless your pre-order has already been dispatched or specifically customised for you, you may contact us to cancel it before dispatch and receive a full refund.

If we are unable to supply a pre-ordered product, we will cancel the affected order and provide a full refund.

9. Delivery

We deliver to eligible addresses within Australia.

Estimated delivery times are displayed on the product page or during checkout. Standard delivery will generally take approximately 5 to 10 business days after dispatch, although remote locations may take longer.

Delivery timeframes are estimates only. Delays may occur because of courier disruptions, severe weather, public holidays, incorrect address information, remote delivery locations or other circumstances outside our reasonable control.

We will provide tracking information where it is available.

You are responsible for providing a secure and accessible delivery address.

If you give the courier authority to leave a parcel unattended, the parcel may be left in accordance with those instructions. Risk passes to you when the order is delivered to the nominated address or left in accordance with your delivery authority.

If a delivery cannot be completed because the address supplied was incorrect, incomplete or inaccessible, you may be responsible for reasonable redelivery costs.

Please inspect your order after delivery and contact us promptly if it appears damaged, incomplete or incorrect.

10. Perth collection

Where collection is offered during checkout or as part of a specific promotion, orders may be collected from our nominated Perth collection location.

We will contact you when the order is ready. Please do not attend the collection location until you have received confirmation.

You may be asked to provide your order confirmation and photographic identification.

Collection availability, dates and times may vary and will be confirmed with you separately.

11. Changing or cancelling an order

Contact us as soon as possible if you need to change or cancel an order.

We will try to accommodate your request, but we cannot guarantee that an order can be changed or cancelled after it has been accepted, packed or dispatched.

If the order has already been dispatched, it may need to be handled as a change-of-mind return under section 12.

Nothing in this section affects your rights where a product is faulty, damaged, incorrectly described or otherwise fails to meet a consumer guarantee.

12. 30-Day Satisfaction Guarantee

In addition to your rights under the Australian Consumer Law, Soilux offers a voluntary 30-Day Satisfaction Guarantee.

We encourage you to try Soilux in your home. If you are not satisfied with the product, you may return it for a refund, even if it has been opened and used.

To make a return under our 30-Day Satisfaction Guarantee:

  • you must contact us within 30 days of receiving the product;
  • you must provide proof of purchase;
  • the product must only have been used for its intended purpose and in accordance with the supplied instructions;
  • the product must be emptied, reasonably cleaned and safely packaged for return; and
  • all accessories and essential components supplied with the product must be returned.

You must contact us and receive return instructions before sending the product back. Products should not be sent to a Soilux address without prior authorisation.

You are responsible for the cost and risk of returning a product under the 30-Day Satisfaction Guarantee. We recommend using a tracked and insured delivery service, particularly for higher-value products.

Once the returned product has been received and checked against the conditions above, your refund will be issued using the original payment method.

Original express-delivery charges and fees for optional services are not refundable. Where standard delivery was provided free of charge, its cost will not be deducted from your refund.

The 30-Day Satisfaction Guarantee does not cover products that have been damaged through misuse, neglect, accident, unauthorised alteration, improper installation or use contrary to the supplied instructions. We may also decline a return where the product is returned in an unsafe or unhygienic condition, or where essential components have not been included.

This voluntary guarantee does not limit or exclude any rights or remedies you may have under the Australian Consumer Law. Different conditions may apply where a product is faulty, damaged, incorrectly described or otherwise fails to meet the consumer guarantees under the Australian Consumer Law.

13. Faulty, damaged or incorrectly supplied products

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.

Goods must, among other requirements:

  • be of acceptable quality;

  • be fit for any purpose that we expressly agreed to;

  • match their description;

  • match any sample or demonstration model; and

  • have any express warranties honoured.

If a product has a minor problem, we may choose to repair the product free of charge within a reasonable time.

If the product has a major problem, you may be entitled to choose between a replacement and a refund. You may also be entitled to compensation for reasonably foreseeable loss or damage caused by the failure.

A major problem may include circumstances where:

  • you would not have purchased the product had you known about the problem;

  • the product is substantially unfit for its normal purpose and cannot easily be made fit within a reasonable time;

  • the product is unsafe;

  • the product is significantly different from its description, sample or demonstration model; or

  • the product cannot perform a specific purpose that you told us about and the problem cannot easily be corrected.

Your Australian Consumer Law rights are not limited to 30 days and are not limited by any manufacturer’s warranty period.

You do not need to return a faulty product unopened or unused to exercise your statutory rights.

We may ask you to provide:

  • proof of purchase;

  • photographs or video showing the issue;

  • the product’s model and serial number;

  • a description of the problem; and

  • reasonable information about how the product has been used and maintained.

We may inspect or test the product before confirming the appropriate remedy.

Where a product is confirmed to have failed to meet a consumer guarantee, Soilux will cover reasonable return or collection costs where required by law. Please contact us before arranging a return so that we can provide suitable instructions.

Consumer guarantees may not apply where damage was caused by misuse, unauthorised modification, accident, neglect, failure to follow the instruction manual, improper cleaning, unsuitable electrical supply or normal wear and tear. This does not affect any rights that still apply under law.

14. Manufacturer warranties

A product may be supplied with an additional written manufacturer’s warranty.

Any manufacturer’s warranty is provided in addition to your rights under the Australian Consumer Law. It does not replace, restrict or exclude those rights.

The duration, scope, exclusions and claims procedure for any additional warranty will be set out in the warranty documentation supplied with the product.

15. Filters, accessories and consumable parts

Carbon filters and other consumable parts have a limited service life that depends on product use, the types of food processed, maintenance and environmental conditions.

Any estimated replacement interval is a general guide rather than a guarantee that a filter will remain effective for a particular period.

A reduction in the performance of a consumable component caused by ordinary use is not necessarily a product fault.

This section does not exclude any rights you may have where a consumable component was defective, incorrectly supplied or not of acceptable quality.

16. Product use and safety

You must use the product only for its intended household purpose and in accordance with the supplied instruction manual.

You must not:

  • place prohibited, non-food or unsuitable items in the product;

  • immerse the appliance, plug or electrical components in water;

  • operate a damaged product;

  • attempt unauthorised repairs or modifications;

  • obstruct ventilation openings;

  • use the product outdoors unless the manual expressly permits it; or

  • allow children to operate the product without appropriate adult supervision.

If you believe the product is damaged or unsafe, stop using it, disconnect it from power where safe to do so and contact us.

17. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

To the maximum extent permitted by law, Soilux is not responsible for indirect or consequential loss that was not reasonably foreseeable when the contract was formed.

We are not responsible for loss or damage caused by:

  • misuse of a product;

  • failure to follow the instruction manual;

  • unauthorised alteration or repair;

  • unsuitable electrical connections or operating conditions;

  • using processed material in a way that is inconsistent with the product guidance; or

  • information provided by you that is inaccurate or incomplete.

This section does not limit our liability for personal injury, fraud, wilful misconduct, breach of a consumer guarantee or any other liability that cannot legally be limited.

18. Events outside our reasonable control

We will not be responsible for a delay or failure to perform an obligation where it is caused by circumstances outside our reasonable control.

This may include severe weather, natural disasters, fire, industrial action, transport disruption, port delays, customs delays, import restrictions, shortages, government action, failures of telecommunications or payment systems, or interruption to courier services.

We will take reasonable steps to minimise the effect of the disruption and will contact affected customers where appropriate.

This section does not remove any right you may have to cancel an order or receive a refund where required by the Australian Consumer Law.

19. Privacy

We collect and use personal information to process orders, take payment, arrange delivery, provide customer support, manage warranties and comply with our legal obligations.

Personal information is handled in accordance with our Privacy Policy and applicable privacy laws.

Third-party payment and delivery providers may collect and process information under their own privacy policies.

20. Communications

We may contact you using the email address or telephone number supplied with your order regarding payment, delivery, collection, product safety, warranty matters or customer support.

Marketing communications will be sent only where permitted by law. You can unsubscribe from marketing emails using the link included in those messages.

21. Complaints and dispute resolution

Please contact us first if you have a concern about an order or product.

We will make reasonable efforts to investigate and resolve complaints fairly and within a reasonable time.

You may also have the right to contact a state or territory consumer-protection agency or pursue any other remedy available under Australian law.

22. Governing law

These Terms are governed by the laws of Western Australia and the applicable laws of the Commonwealth of Australia.

The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and any other court or tribunal that has jurisdiction under applicable consumer law.

Nothing in this section prevents you from exercising rights available in your state or territory.

23. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary.

The remaining parts of these Terms will continue to apply.

24. Changes to these Terms

We may update these Terms from time to time.

The Terms that apply to an order are those published on our website when the order is placed, unless a change is required by law or is more favourable to you.
